Recently, a federal judge in California told the Food and Drug Administration that they need to do the following:

  • Designate a list of “high-risk” foods
  • Create new record-keeping requirements for companies handling those foods

This judge issued his ruling after a lawsuit brought against the agency by two consumer safety groups. These groups said that the government was not implementing the rules in the Food Safety Modernization Act, a law signed by President Obama in 2011.

While we do not have a complete list of which foods are considered “high-risk,” some of them will likely be raw fruits and vegetables such as romaine lettuce, spinach, and cantaloupe. Once these foods get their label, the FDA is supposed to begin forcing the middlemen companies that handle these foods to keep better records of where their ingredients come from and where they are sent. This will be helpful because foods often go through many steps from the farm to the shelves (packers, processors, distributors).

These rules will have two effects:

  • They will push all companies to adopt safer food handling procedures
  • They will help make it easier to track the source of a problem if there is a food poisoning outbreak
